١. ما خير دارنا

خير دارنا تطبيق دليل وحجز يربط من يبيع الأكل البيتي ومنتجات المزرعة بجيرانه الراغبين في الشراء، بدءًا من قرى محافظة المنوفية. لسنا البائع ولا المشتري ولا متجرًا ولا شركة توصيل، ولا نستلم أي مدفوعات داخل التطبيق. يتفق المشتري والبائع على التفاصيل عبر واتساب، ويكون الدفع بينهما مباشرةً.

٢. قبول الشروط

عند إنشاء الحساب يُطلب منك الموافقة على هذه الشروط وعلى سياسة الخصوصية. يُشترط أن يكون عمرك ١٨ سنة فأكثر، وأن تستخدم رقم هاتف يخصّك، وأن تقدّم معلومات صحيحة. إن لم توافق فلا تستخدم التطبيق.

٣. حسابك

• تسجّل الدخول برقم هاتفك ورمز لمرة واحدة، وأنت مسؤول عمّا يجري في حسابك.
• لكل شخص حساب واحد، ولا يجوز استخدام رقم غيرك.
• يمكنك حذف حسابك في أي وقت من تبويب «حسابي» ثم «احذف حسابي». الحذف فوري ولا يمكن التراجع عنه.

٤. الشراء

• الحجز طلب يُرسَل إلى البائع وليس بيعًا ملزمًا؛ للبائع أن يقبله أو يرفضه، والطلب الذي لا يُرَد عليه خلال ٤٨ ساعة ينتهي.
• مراحل الطلب: مُرسَل، ثم مؤكَّد، ثم قيد التجهيز، ثم جاهز، ثم مكتمل. يجوز للمشتري الإلغاء قبل بدء التجهيز.
• افحص المنتج والسعر والكمية عند الاستلام، وادفع للبائع مباشرةً.
• الطعام يعدّه بائعون أفراد، ولا نفتّش المطابخ أو المزارع ولا نضمن الجودة أو السلامة. إن بدا الطعام غير سليم فلا تأكله وأبلغ عنه.

٥. البيع

• لا تعرض إلا ما صنعته أو تملكه ويحق لك بيعه، واجعل بيانات العرض وصوره مطابقة للحقيقة.
• يراجع المشرفون كل عرض جديد قبل نشره، ويجوز لنا رفض أي عرض أو إيقافه أو إزالته.
• أنت المسؤول عن سلامة الطعام ونظافته وعن أي تراخيص أو ضرائب يفرضها القانون عليك.
• ممنوع عرض: المشروبات الكحولية، والمخدرات والأدوية، والتبغ، والأسلحة، والحيوانات البرية أو المحمية أو المريضة، والأطعمة منتهية الصلاحية، وأي شيء يمنعه القانون. الحيوانات الحية مسموحة فقط في فئة «حيوانات مسموحة».
• لا يمكن حذف عرض عليه بلاغ مفتوح أو حجز نشط؛ أوقفه مؤقتًا بدلًا من ذلك حفاظًا على حقوق المشترين.
• يظهر رقم واتساب الخاص بك للمشترين المسجّلين الذين يتواصلون معك من عرض منشور.
• شارة «بائع موثوق» تعني أن المشرفين تحقّقوا من رقم البائع وقريته، وليست ضمانًا للجودة.

٦. قواعد المحتوى: لا تسامح مع المحتوى المسيء

لا يجوز نشر أو رفع أو إرسال أي محتوى (عروض أو أسماء أو صور أو رسائل صوتية أو بلاغات أو رسائل عبر واتساب من التطبيق):

• مخالف للقانون أو احتيالي أو مضلّل، كالأسعار الكاذبة؛
• مسيء أو مهين أو يحض على الكراهية أو العنف، أو فيه تهديد أو تحرّش أو محتوى جنسي؛
• ينتهك حقوق الآخرين أو يُظهر أشخاصًا دون إذنهم؛
• يحاول الإضرار بالتطبيق أو بمستخدميه أو جمع بياناتهم.

لا نتسامح مطلقًا مع المحتوى المسيء أو المستخدمين المسيئين. نزيل المحتوى المخالف ونحظر الحساب المخالف، ونبلّغ الجهات المختصة إذا أوجب القانون ذلك.

الإبلاغ والحظر: استخدم «بلّغ عن المنتج» أو «بلّغ عن البائع» داخل التطبيق. نسعى إلى مراجعة البلاغات خلال ٢٤ ساعة، فنزيل المحتوى المخالف ونحظر صاحبه. ويمكنك كذلك حظر أي مستخدم من صفحته أو من صفحة الحجز، فتختفي عنك عروضه وحجوزاتكما. ويمكنك مراسلتنا على [email protected].

٧. الإيقاف والإنهاء

يجوز لنا إيقاف أو حظر أي حساب يخالف هذه الشروط. ولك أن تتوقف عن استخدام التطبيق أو تحذف حسابك في أي وقت.

٨. حدود مسؤوليتنا

• نقدّم التطبيق «كما هو» ونسعى إلى إبقائه متاحًا، دون ضمان أن يعمل دائمًا بلا أخطاء. ووصول رمز الدخول يعتمد على خدمات رسائل لا نتحكم فيها.
• لسنا طرفًا في البيع بين المستخدمين، والخلافات حول الطعام أو السعر أو الكمية أو التوصيل أو الدفع تكون بين المشتري والبائع.
• كل مستخدم مسؤول وحده عن أي تصرف مخالف للقانون يرتكبه عبر التطبيق أو خارجه. نزيل المحتوى المخالف ونحظر صاحبه، ونتعاون مع الجهات المختصة عند طلبها وفق القانون.
• في الحدود التي يسمح بها القانون، لا نتحمّل مسؤولية أي خسارة أو ضرر ناتج عن منتجات بيعت أو اشتُريت عبر التطبيق أو عن محتوى المستخدمين. ولا يقيّد شيء في هذه الشروط مسؤوليةً لا يجيز القانون المصري تقييدها.

٩. الملكية الفكرية

التطبيق واسمه وتصميمه ملك لـ Mady Labs. تبقى لك ملكية الصور والنصوص التي ترفعها، وتمنحنا ترخيصًا بعرضها في التطبيق وحفظها لتشغيل الخدمة، وينتهي الترخيص بحذفها أو بحذف حسابك.

١٠. التعديلات

قد نعدّل هذه الشروط، ونعلن التعديلات المهمة داخل التطبيق. واستمرارك في الاستخدام بعد التعديل يعني قبوله.

١١. القانون الواجب التطبيق والتواصل

تخضع هذه الشروط لقوانين جمهورية مصر العربية، وتختص المحاكم المصرية بنظر أي نزاع بشأنها.

1. What Khair Darna is

Khair Darna is a catalogue and reservation app that connects people who sell home-cooked food and farm goods with neighbours who want to buy them, starting in the villages of Menofia, Egypt. We are not the seller, the buyer, a shop or a delivery company, and we take no payments in the app. Buyer and seller agree the details on WhatsApp and pay each other directly.

2. Accepting these terms

When you create an account you are asked to accept these terms and the Privacy Policy. You must be 18 or older, use a phone number that is yours, and give true information. If you do not agree, do not use the app.

3. Your account

• You sign in with your phone number and a one-time code, and you are responsible for activity on your account.
• One person, one account; do not use someone else's number.
• You can delete your account at any time: Profile tab → "Delete my account". Deletion is immediate and cannot be undone.

4. Buying

• A reservation is a request to the seller, not a binding sale; the seller may accept or decline it, and a request left unanswered for 48 hours expires.
• Steps: sent, confirmed, preparing, ready, completed. The buyer may cancel before preparation starts.
• Check the product, price and quantity on handover, and pay the seller directly.
• Food is prepared by private sellers. We do not inspect kitchens or farms and do not guarantee quality or safety. If food looks unsafe, do not eat it, and report it.

5. Selling

• List only things you made or own and are allowed to sell, with accurate details and real photos.
• Administrators review every new listing before it is published, and we may reject, pause or remove any listing.
• You are responsible for food safety, hygiene and any permits or taxes the law requires of you.
• Not allowed: alcohol, drugs and medicines, tobacco, weapons, wild, protected or sick animals, expired food, and anything the law forbids. Live animals only in the "Approved animals" category.
• A listing with an open report or an active reservation cannot be deleted; pause it instead, so buyers stay protected.
• Your WhatsApp number is shown to signed-in buyers who contact you from a published listing.
• The "Verified seller" badge means an administrator confirmed the seller's number and village. It is not a guarantee of quality.

6. Content rules: zero tolerance for objectionable content

You may not post, upload or send content (listings, names, photos, voice notes, reports, or WhatsApp messages started from the app) that:

• is illegal, fraudulent or misleading, such as false prices;
• is abusive, offensive, hateful, violent, threatening, harassing or sexual;
• infringes others' rights or shows people without their permission;
• tries to harm the app or its users, or to collect their data.

There is no tolerance for objectionable content or abusive users. We remove such content, ban the account responsible, and report to the authorities where the law requires.

Reporting and blocking: use "Report listing" or "Report seller" in the app. We aim to review reports within 24 hours, removing offending content and banning its author. You can also block any user from their page or from a reservation, which hides their listings and your reservations with them. Or email us at [email protected].

7. Suspension and ending

We may suspend or ban any account that breaks these terms. You may stop using the app or delete your account at any time.

8. Limitation of liability

• We provide the app "as is" and try to keep it available, without promising it will always work error-free. Sign-in codes depend on messaging services we do not control.
• We are not a party to sales between users; disputes about food, price, quantity, delivery or payment are between buyer and seller.
• Each user alone is responsible for any illegal act they commit through the app or outside it. We remove illegal content, ban its author, and cooperate with the competent authorities when they request it under the law.
• To the extent the law allows, we are not liable for loss or harm arising from items sold or bought through the app or from user content. Nothing here limits liability that Egyptian law does not allow to be limited.

9. Intellectual property

The app, its name and design belong to Mady Labs. You keep ownership of the photos and text you upload and give us a licence to show them in the app and store them to run the service; the licence ends when you delete them or your account.

10. Changes

We may change these terms and will announce important changes in the app. Continuing to use the app after a change means you accept it.

11. Governing law and contact

These terms are governed by the laws of the Arab Republic of Egypt, and the Egyptian courts have jurisdiction over any dispute about them.
